This Agreement (“Agreement”) is between Abacus America, Inc. (which may be doing business as I-MAP WEBSOLUTIONS, Names4Ever, Domain Listing Agent, Web Image, Cedant, or other “fictitious” names, and which is referred to in this Agreement as “I-MAP WEBSOLUTIONS”) and you for I-MAP WEBSOLUTIONS’s WhoIs Privacy Service herein referred to as “Privacy Service.”

1. The I-MAP WEBSOLUTIONS Terms of Service Agreement (“TOS”) is incorporated by reference into this Agreement. By agreeing to the terms of this Agreement, you are thereby agreeing to this Agreement, the TOS, and I-MAP WEBSOLUTIONS’s Legal Infringement Policy and Privacy Policy (both of which are incorporated by reference into the TOS).
2. WhoIs Registry. When you select the Privacy Service for a domain name registered through I-MAP WEBSOLUTIONS, we will display only the following public (i.e., WhoIs) information for your domain name:
2.1. Registrant, Technical, Billing and Administrative contact information: Domain Listing Agent (NRPDB) XXXXX@domainlistingagent.com
3. Ownership: You will retain all rights, including all ownership rights, in your domain name, including:
3.1. The ability to sell or transfer each domain;
3.2. The ability to fully manage your domain name servers;
3.3. The ability to create and manage name servers for your domain; and
3.4. The ability to renew your domain upon expiration.
4. Contact Information. You agree to maintain true, accurate and up-to-date contact information for your I-MAP WEBSOLUTIONS account. I-MAP WEBSOLUTIONS will use this information to forward to you correspondence that we receive regarding your domain name.
5. Use. You may elect to use the Privacy Service for domains you have registered with I-MAP WEBSOLUTIONS and for domains you have transferred to I-MAP WEBSOLUTIONS (once your domain registration is complete). You must disable the Privacy Service before you initiate a transfer of a domain to another registrar.
6. Fees: I-MAP WEBSOLUTIONS shall charge you $8.95 USD per year for each domain for which you have elected to use the Privacy Service. No portion of this fee will be refundable, even if your Privacy Service is terminated early. We may modify our pricing for the Privacy Service at any time.
7. Right to Disable or Suspend Privacy Service. I-MAP WEBSOLUTIONS reserves the right, at our sole discretion and without liability to you or any third party, to disable, suspend, or terminate your Privacy Service and to reveal your identity in certain circumstances, including:
7.1. To comply with the law;
7.2. To determine whether an alleged breach of a law has occurred;
7.3. If legal process is served upon I-MAP WEBSOLUTIONS;
7.4. We receive notice of a claim or complaint;
7.5. To avoid legal liability and/or financial loss to I-MAP WEBSOLUTIONS;
7.6. If you use the Privacy Service to conceal your involvement with illegal, illicit, objectionable or harmful activities;
7.7. If you transmit any kind of spam, viruses, worms or other harmful computer programs; and/or
7.8. I-MAP WEBSOLUTIONS receives a UDRP notice.
8. Reservation of Rights: I-MAP WEBSOLUTIONS expressly reserves the right to deny or cancel the Privacy Service for any customer at any time for any reason.
